In March 2012, I was in a motor vehicle collision and was rear ended by a tractor trailer while on duty in my police cruiser and sustained numerous serious injuries. After researching and interviewing several injury law firms I chose Smitiuch Injury Law. Many injury law firms are content to settle cases without going to trial and most cases are resolved this way. My goal was to hire a law firm based on the possibility of going to trial and Mike Smitiuch and Peter Cho had good trial experience. Peter Cho came to my home to review my case and I spoke to Mike numerous times during this early process and they convinced me that I was in excellent hands with their firm. The Smitiuch team helped and guided me through the stressful and lengthy process with a dedicated and supportive group. Mike and Peter advised me that the insurance offer was not acceptable and that we would proceed to trial. The trial started in September, 2017 and lasted three weeks. The trial process is where the Smitiuch team was the most impressive. Mike and Peter had prepared well for trial and had medical, financial and police witnesses set up in a seamless presentation. My case was presented in a clear and precise manner with clarity for the jury. Peter had all charts, visuals and photos set up on the computer for clear presentation for jury members. The closing statements to the jury by Mike Smitiuch were epic and had the jury riveted. On October 5th, 2017 the jury award was in my favour and was higher than expected. The appeal process was next and was handled skillfully and was resolved without an appeal trial due to the diligence, tenacity and negotiating skills of Mike and Peter. I made the mistake of my life hiring Matthew Niewland . I was injured 5 years and five months ago . Matthew went to the questioning unprepared . Although I discussed with him the main points in the mismatch of the other party statements he ignored them . He was texting while being questioned by the other party . He failed to finish the questioning of the other party and blamed it on me . When asked to be paid by the other party for my expenses he said he did not know what law he should refer to and I advised I will look into it . When helping him with the law , he got upset and withdrew as lawyer stating I asked for a second opinion . He used insultive words when refering to me when another lawyer called him to discuss about my case after his withdrawal . The other lawyer opinion was he was a junior lawyer who could not handle my case . His arrogant behaviour denotes lack of accountability and negligence . He kept asking my potential lawyer to pay him , although this contradicts the contract signed . He seems to be concerned about making fast money at the client expense , that's all . I had to successfully bring him to courts to obtain information about my case , which he refused to provide out of ethics and administration of justice when asked before going to courts . His career will be as successful as Ceausescu , the former dictator or my old country . Michael Smitiuch must be a full to keep him employed , but foolish people make fool decisions , and pay the consequences There are many ethical injury lawyers in Toronto , stay away from this arrogant useless Matthew Niewland unless you want to ruin your case and delay your case while suffering serious injury . I noticed Matthew being too cosy with the other party lawyer during the questioning .
