Many years ago I took a moving infraction summons to court. There were numerous errors entered on it by the police officer. When I pointed this out to the court, the judge asked “ are you the one to whom this summons was issued?” I am not a lawyer and being very young, I didn’t know there is different ways to answer questions truthfully. So I answered what the judge asked with an affirmative. His reply to me was “ we can fix that with the stroke of a pen.” If the judge could fix my ticket with stroke of a pen for a guilty finding, why could justice Neil Burgess not call the OPP officer into court, have him or her sworn and, validate it was their report and sign the document? The errant driver then would have been dealt with properly instead of getting a “get out of jail free card?”
